Customer and Product Data Bill – the proposed New Zealand consumer data right regime

The Government has released an exposure draft of the Customer and Product Data Bill - New Zealand's regulatory framework for a consumer data right for consultation. This update provides a summary of the key aspects of the Bill.

Consumer Data Right Update – proposed penalties, supervisory authorities, in-scope sectors and approach to accreditation and fees

The Government has released a Cabinet Paper seeking agreement from Cabinet on certain high-level design elements. Banking is confirmed to be the first cab off the rank for designation under NZ's CDR, but the financial services, energy and health sectors are also flagged as "ranked highly" for designation.

Following the Government's announcement last July that a Consumer Data Right (CDR) framework will be established for New Zealand, Minister Clark has confirmed that banks will be the first sector to implement the CDR mechanism in New Zealand. This update discusses this in more detail including when we can expect draft legislation, key takeaways and next steps.

Statutory review of Australia's Consumer Data Right – a "playbook" for New Zealand

While New Zealand is still waiting on draft Consumer Data Right (CDR) legislation, the Australian Government has recently completed an independent statutory review of its own CDR regime, marking three years since it was first introduced. The Review identifies a number of potential areas for improvement in the Australian regime and makes a range of recommendations for change, providing New Zealand with the opportunity to front foot some of these issues while our regime is still in the "design" phase.

New Zealand Government to introduce a Consumer Data Right

The Government confirmed its decision to establish a Consumer Data Right (CDR) framework for New Zealand this week, with legislation to be introduced as soon as 2022. In the form currently proposed, the New Zealand CDR has the potential to be the widest ranging CDR regime implemented in any jurisdiction to date.

New Zealand Consumer Data Right – MBIE invites submissions

MBIE has released a discussion document seeking submissions on a potential New Zealand Consumer Data Right. Potential in-scope sectors specifically contemplated in the discussion document include banking, electricity and insurance, with MBIE also referencing sectors that have "high search and switch costs" as key areas of consideration.

Consumer Data Right rules established for the Australian banking sector

The Australian Competition and Consumer Commission has announced the finalisation of the Competition and Consumer (Consumer Data Right) Rules. The Rules sit alongside the Treasury Laws Amendment Act 2019, which came into force in August 2019, and provide further detail as to how the Australian regime will operate.

Building a Kiwi Data Economy - Minister to invite feedback

In December 2019, the Hon Kris Faafoi, in his capacity as Minister of Commerce and Consumer Affairs, penned an open letter to New Zealand banks announcing his intention to take advice on the establishment of a legislative framework for a possible Consumer Data Right in New Zealand.
