Profile

Alex is a senior associate in Russell McVeagh’s litigation team. He has acted on a wide range of matters, with particular expertise in:

  • Contractual disputes (including warranty claims).
  • Urgent applications.
  • Judicial review and disputes under the Official Information Act.

In addition, Alex has acted on a number of large-scale transactions by scheme of arrangement, including the recent demerger of Trustpower Limited, and the acquisition of Radius Properties Ltd. 

Experience

Alex's recent cases include:

  • Acting on a number of complex schemes of arrangements, including:
    • appearing as counsel in the demerger of Trustpower by way of scheme of arrangement (Re Trustpower Ltd [2016] NZHC 2499 and [2016] NZHC 1830); and
    • appearing as counsel for a target company in the first takeover of an unlisted company under the amended Companies Act legislation (Re Radius Properties Ltd [2017] NZHC 473).
  • Acting for a property developer in multi-million dollar litigation concerning the distinction between fixtures and chattels (Queenstown Central Ltd v March Construction Ltd [2016] NZHC 1884.
  • Acting in arbitral proceedings on a number of confidential contractual disputes between a windfarm and its turbine manufacturer.
  • Acting for an international bank in a multi-million dollar claim regarding the potential invalidation of a guarantee. 
  • Advising a number of New Zealand's largest companies in relation to warranty claims and other contractual disputes (including purported repudiations).
  • Acting for an insurer in a multi-million dollar "mistaken payment" and subrogation dispute. 
  • Providing advice to large multi-national corporates in relation to decisions made under the Official Information Act, including by the Overseas Investment Office.

Professional

Alex started working at Russell McVeagh as a graduate in 2011, and was admitted to practise in New Zealand in 2012. He was appointed a senior solicitor in 2014, and a senior associate in 2017.
